1. Acceptance of these Terms

These Terms and Conditions apply to the website operated by Melandah Foundation and to services made available through the website. They are intended to create a clear and fair understanding between Melandah Foundation and website users.

If you do not agree with these Terms, please do not use the website or submit information through it. Certain activities may also be subject to additional terms, application rules, consent forms, safeguarding requirements, event conditions or agreements. Where additional terms apply, they form part of the arrangement for that activity.

If there is a direct conflict between these general Terms and a specific written agreement signed by Melandah Foundation, the signed agreement will take priority for the matter it covers.

2. About Melandah Foundation

Melandah Foundation is a Bangladesh-based non-profit organisation working in humanitarian assistance, education, youth development, community wellbeing, environmental action, volunteering and responsible global engagement.

The Foundation is preparing for, or has completed, registration in Bangladesh. Registration information should be published only after formal approval:

Nothing on this website should be understood as claiming a registration, regulatory status, approval, accreditation, partnership or authority that has not yet been formally granted.

3. Using this website

You may use this website for lawful, personal, informational and community-related purposes. You may view, print or download a reasonable amount of public material for your own non-commercial use, provided you do not remove copyright notices, alter the meaning or present the material in a misleading way.

You must not:

• use the website for unlawful, fraudulent, abusive or harmful activity;
• attempt to gain unauthorised access to the website, accounts, forms, servers or connected systems;
• introduce malware, malicious code, automated attacks or harmful material;
• scrape, harvest or systematically extract information without permission;
• impersonate Melandah Foundation, a trustee, volunteer, employee, partner or beneficiary;
• misrepresent an affiliation, endorsement, approval or partnership;
• copy or reuse our branding, photographs, reports or content for commercial or misleading purposes;
• interfere with the website’s security, availability or proper operation.

4. Information provided on the website

We try to keep website information clear, accurate and current. However, our activities develop over time and some information may become incomplete, outdated or unavailable. Unless we expressly say otherwise, website content is provided for general information and does not amount to legal, financial, medical, immigration, travel, safeguarding or other professional advice.

Programme details, dates, eligibility requirements, funding, locations, application deadlines and available places may change. Publication of an opportunity does not guarantee that the activity will proceed or that any applicant will be selected, funded, admitted or supported.

Where you need professional advice, you should obtain advice from an appropriately qualified and authorised professional.

5. Applications and expressions of interest

When you submit an application, expression of interest, registration or enquiry, you confirm that the information provided is accurate, complete and not misleading to the best of your knowledge.

We may ask for further information, supporting documents, references, an interview, parental consent, identity verification, safeguarding checks or evidence of eligibility. We may reject, pause or close an application where:

• the eligibility requirements are not met;
• information is incomplete, false, inconsistent or misleading;
• the deadline has passed or places are no longer available;
• there are safeguarding, conduct, security or reputational concerns;
• the activity is changed, postponed, cancelled or not funded;
• selection would conflict with law, regulation, donor conditions or organiser rules.

Submission does not create an employment relationship, volunteer placement, partnership, scholarship, grant, sponsorship, nomination or right to participate.

6. Volunteering

A volunteer role is not employment and does not create a right to salary, benefits, continued engagement or reimbursement unless this is specifically agreed in writing.

Volunteers may be required to follow role descriptions, codes of conduct, safeguarding rules, confidentiality requirements, health and safety instructions and lawful directions from authorised leaders. Expenses are reimbursable only where they were approved in advance and supported by the required evidence.

We may decline, suspend or end a volunteer arrangement where this is reasonably necessary because of conduct, performance, safeguarding, safety, conflict of interest, operational need, lack of funding or damage to trust and confidence.

7. Delegate, international and travel opportunities

Melandah Foundation may share, nominate or support suitable individuals for conferences, camps, exchanges, volunteering, leadership programmes or other opportunities. Unless expressly confirmed in writing:

• an application does not guarantee selection or nomination;
• a nomination does not guarantee acceptance by the organiser;
• selection does not guarantee funding, a visa, entry clearance, admission or travel;
• participants remain responsible for passports, visas, insurance, health requirements and compliance with immigration and border rules;
• organisers, airlines, embassies and public authorities make their own independent decisions;
• dates, venues, fees and programme arrangements may change.

Applicants must not present an application, nomination letter or Foundation communication as a visa guarantee, employment offer, sponsorship certificate or government endorsement.

Where funding is available, it may be subject to written conditions, evidence of expenditure, attendance, reporting and repayment if the funds are misused or the agreed conditions are not met.

8. Donations

Donations support the charitable and community purposes of Melandah Foundation. Unless a specific restricted appeal is clearly stated and accepted by us, donations may be used where the Foundation reasonably considers the need and impact to be greatest within its lawful purposes.

A donor must use a payment method they are authorised to use and must provide accurate information. We may refuse, return, hold or report a donation where required by law or where there are reasonable concerns about fraud, money laundering, sanctions, corruption, misuse, donor identity, source of funds or conditions inconsistent with our values or legal obligations.

Online payments may be processed by banks, payment providers or fundraising platforms. Their own terms and privacy policies may also apply.

Restricted donations

If a donation is expressly accepted for a named project or purpose, we will aim to use it for that purpose. If the purpose is completed, becomes impractical, unlawful, unsafe, overfunded or cannot proceed, we may contact the donor where reasonably possible or apply the funds to a closely related charitable purpose, subject to applicable law and any binding donor agreement.

Refunds

Donations are generally voluntary and non-refundable. We may consider a refund where there is clear evidence of an accidental duplicate payment, unauthorised transaction, technical error or another exceptional reason. Any request should be made promptly and will be considered in light of applicable law, payment-provider rules and whether the funds have already been committed or spent.

9. Fundraising in our name

No person may organise an event, appeal, collection, campaign or crowdfunding page in the name of Melandah Foundation without prior written approval.

Approved fundraisers must act honestly, follow our instructions, comply with applicable law, keep accurate records, protect donor information and transfer funds promptly through an approved method. They must not suggest that they are employees, agents or official representatives unless formally appointed.

We may withdraw permission to use our name or branding where an activity presents legal, financial, safeguarding or reputational risk.

10. Safeguarding

The safety, dignity and wellbeing of children and vulnerable people are central to our work. Everyone engaging with our programmes, events, online spaces or activities must follow our Safeguarding Policy and any activity-specific procedures.

We may share information with safeguarding leads, emergency services, statutory authorities or other competent bodies where reasonably necessary to protect a person, manage a serious risk or comply with law. Safeguarding confidentiality cannot be promised where doing so would place someone at risk.

11. Acceptable conduct

Users, applicants, volunteers, participants and supporters are expected to communicate respectfully and honestly. We will not accept:

• harassment, threats, intimidation, hate speech or abusive conduct;
• discrimination or degrading treatment;
• sexual misconduct, exploitation or safeguarding breaches;
• fraud, bribery, corruption, misuse of donations or false expense claims;
• unauthorised disclosure of confidential or personal information;
• conduct likely to place people, property, programmes or the Foundation at unreasonable risk.

We may remove content, restrict contact, cancel participation, report concerns or take other proportionate action where these standards are breached.

12. Intellectual property

Unless otherwise stated, the website, logo, name, design, written content, graphics, publications, videos, photographs and other original materials are owned by or licensed to Melandah Foundation.

You may share a public webpage through ordinary social media sharing tools and may quote a short extract for genuine non-commercial, educational or reporting purposes with clear attribution.

You may not, without prior written permission:

• use our logo or branding in a way that implies endorsement or partnership;
• reproduce a substantial part of the website or a publication;
• sell, license or commercially exploit our content;
• alter photographs, reports or statements in a misleading way;
• use beneficiary images or stories for fundraising, advertising or political purposes;
• register a confusingly similar domain, page, account, organisation or campaign name.

Third-party trademarks, photographs and materials remain the property of their respective owners.

13. Photographs, video, stories and media

Photographs and stories on this website may show volunteers, participants, community members or beneficiaries. They must be treated with dignity and must not be downloaded, edited, republished or used out of context in a way that is harmful, exploitative or misleading.

Permission to attend an event does not automatically give a person permission to photograph or publish identifiable children, safeguarding cases or private activities. Separate consent and event rules may apply.

If you believe an image or story concerning you has been published incorrectly, contact us. We will consider the circumstances, consent, safeguarding, public interest, legal obligations and practical ability to remove material already shared by third parties.

14. Third-party websites and services

The website may contain links to organisations, social media sites, payment providers, event organisers, embassies, travel providers or other third parties. Links are provided for convenience and do not automatically mean that Melandah Foundation controls, approves, endorses or guarantees the third party.

Third-party websites and services have their own terms, fees, eligibility rules and privacy practices. You should review them before using the service, making a payment or providing personal information.

By providing information, you confirm that you are entitled to provide it and that, where you submit information about another person, you have an appropriate basis or authority to do so.

16. Website availability and security

We aim to keep the website available and secure, but uninterrupted or error-free access cannot be guaranteed. The website may be suspended, restricted or changed for maintenance, security, technical, operational or legal reasons.

You are responsible for using suitable devices, software, security measures and internet access. You should not rely on the website as the sole source of urgent, emergency or safeguarding assistance.

17. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or any other liability that applicable law requires us to retain.

Subject to that principle, Melandah Foundation will not be responsible for indirect, incidental or consequential loss arising solely from use of, or inability to use, the website; reliance on general website information; third-party services; internet failure; malicious activity outside our reasonable control; or changes made by external organisers, authorities or service providers.

We do not guarantee a particular result from a donation, application, volunteer role, programme, referral, nomination or third-party opportunity. Decisions made by embassies, regulators, event organisers, schools, payment providers, airlines, public authorities and partner organisations remain their responsibility.

Where we are legally liable, any limitation will be interpreted only to the extent permitted by applicable law and in light of the nature of the relevant relationship.

18. Your responsibility for misuse

You are responsible for losses or claims caused by your unlawful or fraudulent use of the website, deliberate misuse of our name or intellectual property, unauthorised fundraising, false statements or serious breach of these Terms.

This clause does not require an individual to compensate us for a loss caused by our own negligence or wrongdoing, and it will apply only to the extent permitted by law.

19. Suspension or termination

We may restrict or terminate access to website services, applications, events, programmes or volunteer activities where reasonably necessary to protect people, systems, funds, legal compliance, safeguarding, security or the reputation and proper operation of the Foundation.

Clauses concerning intellectual property, confidentiality, privacy, liability, misuse, governing law and outstanding obligations may continue after access or participation ends.

20. Governing law and disputes

These Terms are governed by the laws of Bangladesh, subject to any mandatory rights that apply to a user in another jurisdiction and cannot lawfully be excluded.

Before starting formal proceedings, both parties should try in good faith to resolve the matter through direct communication. Complaints should be submitted through our published complaints procedure or by contacting us using the details below.

Unless mandatory law requires otherwise, the courts of Bangladesh will have jurisdiction over disputes arising from these Terms.

21. Changes to these Terms

We may update these Terms when our activities, website, services, legal obligations or organisational structure change. The revised version will be published on this page with a new “Last updated” date.

Changes will apply from the stated effective date. Where a material change affects an existing application, donation or programme, we will provide additional notice where reasonably appropriate.
